If your status doesn`t establish a position of trust, you can set one up in another state. Assets that cannot be physically displaced may not be protected. External receivables are not limited to the company`s assets and may extend to your personal wealth. For example, if the same company owned a truck that you drove carelessly in a large number of pedestrians, the injured could not only sue the company, but also you, and respond to any judgment of the ownership of the company as well as your personal fortune. Over the years, many different strategies have been developed to purring the protection of assets. Some of these plans employ long-standing legal entities to satisfy their intent, while others are shameful, even illegal, and encourage fraud to earn money on innocent and uneducated. Some of the most common legal vehicles used to protect assets include businesses, partnerships and trusts. As with any succession planning technique, a DAPT must meet certain criteria to be valid. In essence, the courts have always been able to impose a marital agreement in order to avoid an unfair result. How can we know, when colluding with a marriage agreement, what will seem unfair to a court (which we cannot choose) for several years (and variations of wealth) on the way to the top? There has never been a guaranteed answer to this question, but lawyers and attentive parties will take steps to make marital agreements fairer. Unlike asset protection strategies, divorce marriage contracts do not offer complete protection of your wealth or business income in the event of divorce. Alternatively, spousal agreements, while relatively simple and harmless, do not have strong jurisprudence. They do not have strong balance sheets for consistent asset ownership protection in property disputes.

Many types of assets are exempt from creditors` claims. Thus, the home exemption protects homeowners from forced sales of homes to pay off their debts. It is therefore important to consider the types of assets that are included in creditors` claims and the likelihood that each asset will be seized in the event of an appeal.
